MM&R Secures Appellate Court Win for Freight Brokers

Matthew Koch and William Ryan help secure a big appellate court win for freight brokers in Ying Ye v. GlobalTranz, 74 F.4th 453 (7th Cir. 2023) – Seventh Circuit rules that the plain text and statutory scheme indicate that the Federal Aviation Administration Authorization Act (“FAAAA”), 49 U.S.C. § 14501(c)(1), preempts and bars negligent hiring claims against freight brokers seeking wrongful death damages arising out of trucking accidents, and that the Act’s safety exception in § 14501(c)(2)(A) does not save negligent hiring claims from preemption.
